1. Agreement to Terms

By accessing or using Sonari's website and services, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you may not access the service.

2. Description of Service

Sonari is a mobile language learning application focused on pronunciation improvement. The app uses audio recording, visual learning aids, character drawing input, and machine-learning-powered speech-to-text technology to help users master pronunciation. Currently, we offer a waitlist for early access to our Japanese pronunciation training service. The service includes real-time speech analysis, adaptive drills, progress tracking, and handwriting practice.

3. Waitlist and Early Access

Joining the waitlist does not guarantee access to the service. Early access will be granted at our discretion. Waitlist position does not necessarily determine access order. We reserve the right to modify or discontinue the waitlist program at any time.

4. User Accounts

When the service launches, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the service
• Submit false or misleading information
• Use automated systems to access the service without permission
• Reverse engineer or decompile any part of the service

6. Intellectual Property

The Sonari name, logo, website design, content, and all associated intellectual property are owned by Sonari Inc. You may not use, reproduce, or distribute any of our intellectual property without prior written consent.

7. User Content

When using Sonari's pronunciation features, audio recordings are processed in real time by our machine learning speech-to-text engine to evaluate and score your pronunciation. Drawing and handwriting input is analyzed for character accuracy. We may use anonymized and aggregated data from user interactions to improve our speech recognition models, pronunciation scoring algorithms, and overall service quality. You retain ownership of your personal recordings and drawing input.

8. Privacy

Your use of Sonari is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Payment Terms

Sonari is currently in pre-launch phase and the waitlist is free to join. When paid features are introduced, pricing and payment terms will be communicated in advance. Any fees are non-refundable unless otherwise stated.

10. Free Trial and Subscription

We may offer free trials or promotional access at our discretion. After any trial period, continued access may require a paid subscription. We will clearly communicate any transition from free to paid access.

11. Service Availability

We strive to keep Sonari available at all times but do not guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or damage resulting from service unavailability.

12. Modifications to Service

We reserve the right to modify, suspend, or discontinue any part of the service at any time without prior notice. We may add or remove features, change supported languages, or adjust functionality as we see fit.

13. Disclaimer of Warranties

The service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that using Sonari will result in any particular level of language proficiency. Language learning outcomes vary by individual. Our machine learning models for speech-to-text and pronunciation scoring provide approximations and may not be 100% accurate in all cases.

14. Limitation of Liability

To the maximum extent permitted by law, Sonari Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

15. Indemnification

You agree to indemnify, defend, and hold harmless Sonari Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the service or violation of these Terms.

16. Termination

We may terminate or suspend your access to the service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination shall remain in effect.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

18. Dispute Resolution

Any disputes arising from these Terms or your use of the service shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association.

19. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible, and the remaining provisions will continue in full force and effect.

20. Waiver

The failure of Sonari to enforce any right or provision of these Terms will not be considered a waiver of those rights. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Sonari Inc.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Sonari Inc. regarding your use of the service and supersede all prior agreements and understandings.

22. Assignment

You may not assign or transfer these Terms or your rights under them, in whole or in part, without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

23. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the updated Terms on our website. Your continued use of the service after changes are posted constitutes acceptance of the revised Terms.
